Birth injury during delivery resulting in cerebral palsy. The OBGYN delayed delivery by C-section despite non-reassuring fetal monitoring strips. When the mother was finally taken to the OR for an emergency C-section, the hospital failed to have a pediatrician or other qualified physician present to resuscitate the baby. Settled for $3.8 million.

44-year-old man admitted to the hospital for Covid and intubated for 4 weeks. Nursing staff failed to timely and adequately reposition his body while in a coma. As a result, he developed a stage 4 pressure ulcer (large, deep wound that extends to the bone). Patient suffered permanent nerve injury, non-healing wound and bone infection that required removal of the tail bone. The case was subject to a tort claim cap limit. Settled for $1.8 million.

Hospital Sepsis Mismanagement / Wrongful Death
46-year-old man underwent a knee replacement. 5 days after being discharged from the hospital he developed signs and symptoms of infection. He returned to the hospital and sepsis was suspected. Proper sepsis protocol was not followed and the patient died 26-hours after admission. The case was subject to a state cap of $250,000 for emotional pain and suffering. The family could only recover lost earnings and the capped amount of emotional pain and suffering. $1.8 million – settled on appeal following trial.

56-year-old man underwent a hip replacement surgery. He developed unusual, severe abdominal pain in the hospital but was discharge home without adequate evaluation. Four days later he was rushed to the hospital in septic shock as a result of a ruptured bowel, resulting in 2 months of hospitalization, multiple surgeries and placement of colostomy bag. Settled for $1.7 million.

29-year-old woman underwent shoulder surgery for a rotator cuff repair. During the procedure the orthopedic surgeon improperly implanted an anchor which was driven through the humeral head bone and ended up in the armpit causing nerve and tissue damage. Settled $1.6 million

Emergency Room Malpractice / Failure to Transfer
37-year-old man involved in single car accident. He went to the emergency room where a CT and X-ray revealed a severe, displaced acetabular fracture (hip fracture) that clearly required urgent surgery to repair. Instead of transferring to a hospital capable of such a repair, the patient was sent home. The patient returned to the ER two days later in pain and with evidence of a blood clot in his leg. He was transferred to a hospital where surgery was unnecessarily delayed for days, and the blood clot risk ignored. The patient died of pulmonary embolism following surgery days later. The case was subject to a tort claim cap that limited the family’s recovery. Settled for $1.5 million.

A 76-year-old man underwent a cervical spine fusion (neck). The nurses failed to respond to hours of declining respiratory status and increasing difficulty breathing. Patient’s wife repeatedly asked the nurses to re-evaluate but her requests were ignored. The patient went into respiratory failure and later died. Settled for $1.3 million.

34-year-old woman went in for sinus surgery. During the procedure, the surgeon lost his bearings in the sinus and instead of removing the tissue in the sinus, he broke through the eye orbit and removed part of her eye and severing ocular muscles resulting in permanent impairment of vision in the eye. Settled for $1.2 million.

Primary Care Malpractice / Altered EMR Audit Records
41-year-old man went to his primary care doctor for a routine physical. Lab work revealed abnormal kidney numbers. The PCP failed to order an urgent consult with a kidney specialist causing a month and a half delay in diagnosis and treatment. During the litigation it was discovered the doctor had falsified the record related to the referral to a specialist. The patient suffered kidney failure requiring dialysis and kidney transplant. Settled for policy limits $1 million.

Gynecological Surgical Error / ER Failure to Diagnose
52-year-old woman underwent hysterectomy. During the procedure the surgeon damaged the ureter (tube leading from the kidney to the bladder) and lacerated the vagina requiring sutures. Patient was discharged without further studies or follow up plan and the ureter injury undiscovered. Despite multiple ER visits with abnormal findings of fluid in her abdomen and worsening labs, the surgeon and urologist declined to investigate. Settled for $900,000.

50-year-old man underwent bowel resection surgery. Nursing staff failed to remove a portion of the post-operative drain/catheter from his abdomen prior to discharge. Pt repeatedly complained of pain in his abdomen for months. An x-ray was obtained a year later revealing approx. 8-inches of catheter tubing retained in his abdomen. $850,000 verdict.
